General Information
- These terms are subject to change without warning or notification.- I have the right to refuse any commission for any reason.
-- I do not have to state the reason.- Repeated misconduct, harassment, abuse, or rudeness will result in your order being refunded and may result in you being blacklisted from all future commissions/character sales/adoptable sales.- I do not sell in USD to minors. No exceptions.- Any chargebacks filed against my account will be fought and you will be blacklisted from all future commissions/character sales/adoptable sales.- As of August 2022, I collect and remit sales tax to the State of Texas. Sales tax is included in the total price of your order, there will not be an additional charge.
Subject Matter
- I will not draw humans or gijinkas.
-- This is because I lack practice with the subject matter and am not currently comfortable with the quality of work I would be creating.- I will not create work that is racist, homophobic, transphobic, or otherwise hateful, discriminatory, bigoted, or offensive. I am the judge of this, not you.
-- This specifically includes appropriation of Indigenous traditional arts and sacred objects such as dream catchers, headdresses, feathers and feather jewelry worn on the head, and outfits/accessories clearly inspired by Indigenous regalia or traditional clothing.- I will not copy another artist’s style, poses, interactions, character design, creative filters, blending modes, etc. or use them as “inspiration.”- I will not draw trademarked characters.
-- I will also not draw heavily stylized fandom characters in their branded style including but not limited to: Five Nights at Freddy's, Homestuck, My Little Pony, Sonic the Hedgehog, Undertale.
General Process
- After a slot has been claimed, you have 48 hours to fill out a form.- After claiming a slot and sending a form, I will send you an invoice via e-mail for payment in USD. I do not accept fake currencies or gift cards unless I say otherwise on the commission post.- Your artwork will normally be completed in one to three weeks, but please allow at least 60 days before requesting a refund from me.- I am more than happy to make changes to your commission if it is an error on my part, such as a missed marking, an unclipped layer, or similar error.
-- If you would like significant changes made that were not included in your form or reference, I will make up to two changes at no extra cost. Any extra work beginning with the third change will be charged by the hour.
-- I will not make stylistic changes.
Payment Information
- Payment is accepted only as USD unless otherwise noted.
-- I will send you an invoice after confirming your commission.- I will not accept or arrange payment plans.- I will not begin work on your commission until payment has been received.
-- Payment must be received within 48 hours of the invoice being sent or your slot will go to the next person in line.
-- I do not accept e-checks. I have them disabled, but if for some reason your payment goes through as one, I will refund it.
Refund Policy
- Although refunds may be requested at any point in the commission processes, refunds will only be made in full if:
-- I, the artist, initiate the refund due to a breach of these terms;
-- 60 days have passed without completion of your order; or
-- the refund is requested before work has been started on your order.- Partial refunds are offered after work has been started, in proportion to the amount of work that has been competed.- In any situation, I will initiate the refund.
-- Filing a chargeback against my account will result in you being blacklisted.- I do not do refunds on premade designs.
-- If you file a chargeback against my account after purchasing a design, you will be blacklisted from all future sales/commissions and you will forfeit all rights to the design.
Usage and Rights
- By commissioning me, you are receiving partial rights to the artwork for personal use. You retain the rights to the characters depicted and license to post the work, but the copyright of the artwork itself will be retained by myself as the artist.
-- For commercial usage, contact me to discuss!- You may not edit the artwork without my permission.
-- Exceptions: You may add your own watermark, resize the artwork, or crop the artwork for use in Toyhou.se or similar icons.- You are allowed to repost your artwork as long as I am credited.- If you wish for a commission to be private, please tell me in advance, otherwise I reserve the right to post your commission publicly and include it in my portfolios.- My artwork can travel with characters when they are sold and traded.- You may not include my artwork in generative AI training data or use generative AI to alter my artwork.- You may not use your commission in any blockchain-related technology, including NFTs (non-fungible tokens), cryptocurrencies, or future inventions in the space.
Design/adoptable Terms
- The only rule attached to my character designs/adoptables is to credit me on future reference images.
-- If you commission or create a new reference image my credit must remain visible on the reference image, even if the design is revamped.- My designs are sellable, tradable, giftable, co-ownable, revampable, etc.- You have full personal and commercial rights to the character design.
-- The reference image I provide is personal use only. Any future artwork you commission or create featuring the character's likeness may be used for commercial purposes.- NO REFUNDS. I do not do refunds on premade designs.
-- If you file a chargeback against my account after purchasing a design, you will be blacklisted from all future sales/commissions and you will forfeit all rights to the design.
